Minutes of a Regular Council Meeting held in the City Hall Council Chambers, Courtenay B.C., on Tuesday August 7, 2007 at 4:00 p.m.

The meeting was called to order at 4:00 p.m.
1.00 MINUTES
Moved by Jangula and seconded by Presley that the minutes of the regular Council meeting held July 3, 2007 be adopted.

2.00 INTRODUCTION OF LATE ITEMS
Mayor Winchester approved the addition of one late item to the agenda.
4.00 COMMITTEE/STAFF REPORTS
.01 OCP AMENDMENT GREENWAY STRATEGY 6480-20-0702
Moved by Leonard and seconded by Presley that Council approve amending Map No. 2 Long Range Plan, and Map No. 3 Road Network Plan of the Official Community Plan to include future Greenways and Walkways as a result of new and projected development as outlined on Attachments A and B to Official Community Plan Amendment Bylaw No. 2508, 2007;
That Official Community Plan Amendment Bylaw No. 2508, 2007 proceed to 1st and 2nd reading; and
That a Public Hearing be held on August 20, 2007 at 5:00 p.m. in the City Hall Council Chambers in relation to Bylaw No. 2508, 2007.

.02 STREET NAMES MCNISH 5450-01
Moved by McRae and seconded by Presley that the street name McNish be placed on the street name reserve list for the City of Courtenay.

.03 STREET NAMES BALL 5450-01
Moved by Leonard and seconded by Phelps that the name Ball be placed on the street names reserve list; and
That the Director of Operational Services write to the applicant and advise that the name Ball will be placed on the reserve list for a future development in the City of Courtenay.

.04 STATUTORY R.O.W. BOULDING, HAY, BERNIAZ 3320-20-06490
Moved by Leonard and seconded by Presley that Council approve the Statutory Right of Way Agreement through Lot A, District Lot 158, Comox District, Plan VIP (yet to be assigned); and
That the Mayor and Manager of Corporate Administration be authorized to sign all documentation relating to this development.

Moved by McRae and seconded by Phelps that Traffic Regulation Amendment Bylaw No. 2506, 2007 proceed to first, second and third readings.

.06 2007 HOUSE OF COMMONS PRE-BUDGET SUBMISSION 1705-01
Moved by Theos and seconded by Presley that Council approve the Pre-Budget Submission to the House of Commons Finance Committee;
That a copy of the submission be sent to the Federation of Canadian Municipalities ; and
That the Mayor be approved to sign the submission on behalf of Council.

5.00 REPORTS AND CORRESPONDENCE FOR INFORMATION
.01 CULTURAL CAPITALS OF CANADA
Moved by Jangula and seconded by Phelps that the report from the Comox Valley Economic Development Society regarding the Cultural Capital of Canada be received for information; and
That a letter of appreciation be sent to the Comox Valley Economic Development Society.

6.00 RESOLUTIONS OF COUNCIL
.01 IN CAMERA MEETING
Moved by Presley and seconded by Phelps that under the provisions of Section 90(1) (c) of the Community Charter, notice is hereby given that a special In Camera meeting closed to the public will be held August 7, 2007 at the conclusion of the Regular Council Meeting.

7.00 UNFINISHED BUSINESS
Mayor Winchester inquired whether there were any members of the public wishing to make a submission regarding Development Variance Permit No. 0713, and there were none.
.01 DVP 0713 BAKER 3060-20-0713
Moved by McRae and seconded by Jangula that Development Variance Permit No. 0713 be issued to Tim and Janice Baker to provide relief from the City of Courtenay Zoning Bylaw No. 2500, 2007, and amendments thereto, to reduce the required watercourse setback from the natural boundary of the Puntledge River from 30 metres to 12 metres to allow for the renovation and addition of a sundeck as shown on Schedule No. 1, for the property legally described as Lot 3, Section 118, Comox District, Plan 41256 at 1075 1st Street; and
That if the permit holder has not substantially commenced any construction to which the permit was issued within twelve (12) months after the date it was issued, the permit lapses.

9.00 NEW BUSINESS
.01 REGIONAL DISTRICT LETTER TO MINISTER
Moved by McRae and seconded by Jangula that
WHEREAS the Government of British Columbia has seen fit to divide the Comox Strathcona egional District into two new regional districts;
AND WHEREAS the new Comox Valley Regional District will better serve the needs of the residents of the Comox Valley in the coming years;
AND WHEREAS the issues facing the Comox Valley are substantially different than those being dealt with in the northern part of the Comox Strathcona Regional District;
AND WHEREAS the Government of British Columbia has mandated a need for both the rural and urban areas to work together to best meet their needs by way of a formal regional growth strategy plan, infrastructure cooperation, and the creation of a more equitable representation by population voting structure;
AND WHEREAS the new Comox Valley Regional District will allow both urban and rural residents to decide the political direction of the Comox Valley;
NOW THEREFORE BE IT RESOLVED that the City of Courtenay send a letter to the Premier, Minister of Community Services, and our MLA thanking the Government of British Columbia for allowing the residents of the Comox Valley to have a regional district that best represents their political, social, and environmental needs both for today and the future.
