Minutes of a Regular Council Meeting held in the City Hall Council Chambers, Courtenay B.C., on Monday, February 11, 2008 at 4:00 p.m.

The meeting was called to order at 4:04 p.m.

           Moved by Jangula and seconded by Phelps that the minutes of the regular Council meeting held February 4, 2008 be adopted.

2.00  LATE ITEMS
 
Acting Mayor Presley approved the addition of 2 late items to the agenda.
 
3.00  DELEGATIONS
 
1.         Comox Valley Land Trust re:  Conservation Strategy
 
Jack Minard of the Comox Valley Land Trust made a presentation regarding the Comox Valley Conservation Strategy, and presented specific recommendations for Council’s consideration.
 
.01 Comox Valley Conservation Strategy
 
           Moved by Jangula and seconded by Theos that Council commit to regional conservation planning in the City of Courtenay and with all local governments and community partners; and
 
That recommendation #2 and #3 from the Comox Valley Conservation Strategy Working Group be referred to staff to provide a report to Council approximately one month after the “Conservation in Land Use Planning Workshop” to be held March 13th, 2008.

 2.         Karl Wein & Associates re:  2270 Cliffe Avenue Zoning Application
 
Karl Wein reviewed the application from Brookmere Investments Ltd. to rezone property located at 2270 Cliffe Avenue to permit a mixed-use eight storey building.
 
4.00  COMMITTEE/STAFF REPORTS
 
.01 Fire Report
            Moved by Leonard and seconded by Phelps that the Fire Report for January 2008 be received for information.

Fire Chief Don Bardonnex made a presentation regarding Fire Department live fire training which took place on Saturday February 9th at a donated house on Baird Road.
 
            Moved by Phelps and seconded by Leonard that Council send a letter of appreciation to the owner of the building provided to the Fire Department for live fire training.

.02 Zoning Amendment Brookmere Investments 3360-20-0704

            Moved by Leonard and seconded by Theos that Council authorize staff to draft a Zoning Amendment Bylaw to amend Zoning Bylaw No. 2500, 2007 to rezone that portion of the property legally described as Lot A, Section 66, Comox District, Plan 34998 except that Part in Plan 49713 from Commercial Two Zone (C-2) to a site specific Comprehensive Development Eighteen Zone (CD-18) that would permit the development of a mixed-use, eight storey building.
 
            Moved by Leonard and seconded by Jangula that the proposed amenity of four rental apartment units be increased to five.

            Moved by Theos and seconded by Phelps that the proposed parking space ratio for the residential component be increased to 1.25 from 1.

.03 Zoning & OCP Amendment 3L Developments 6480-20-0701/c

            Moved by Theos and seconded by Jangula that Official Community Plan Bylaw No. 2387 Amendment Application 6480-20-0701 and Zoning Bylaw No. 2500 Amendment Application 6480-20-0701be referred to the February 18th, 2008 regular meeting of Council.

            Moved by Jangula and seconded by Leonard that the Police Report for January 2008 be received for information.

.02 Minister Chong New Regional Districts 470-20

            Moved by Phelps and seconded by Jangula that the Order in Council No. 59 and Letters Patent for Incorporation of New Regional Districts be received for information.

9.00  NEW BUSINESS
 
.01 CV Social Planning Society Rep 5080-01
 
            Moved by Leonard and seconded by Theos that the letter from the Comox Valley Social Planning Society be received for information: and
 
That Council appoint a representative to attend the Society meetings.
Defeated with Councillor Leonard in favour

          Moved by Leonard and seconded by Theos that the City request the minutes of the Comox Valley Social Planning Society meetings.

.02 Hawk Drive Traffic Calming
 
Councillor Phelps inquired about a traffic accident that occurred on Hawk Drive recently.
 
Sandy T. Gray advised that an accident occurred on February 6th involving two moving vehicles and a parked vehicle. He advised that the RCMP are investigating the accident and the matter will be referred to the East Courtenay Traffic Calming group once the investigation is complete, with a report to Council within 60 days.
 
.03 Grafitti

Councillor Phelps reviewed the continuing concern regarding graffiti in the City and reviewed the “Wiping out graffiti” forum to be held February 21st, 2008 at 7:00 p.m. in the Sid Williams Theatre lower lounge. 
  
11.00  COUNCIL MEMBER ROUNDTABLE
  
Councillor Leonard reviewed her attendance as an observer at the meeting of the Steering Committee for the Task Force for Homelessness.
  
Acting Mayor Presley thanked Randy Wiwchar for his efforts regarding the Spirit 2010 events.
