Minutes of a Regular Council Meeting held in the City Hall Council Chambers, Courtenay B.C., on Monday, February 9, 2009 at 4:00 p.m.

The meeting was called to order at 4:00 p.m. 
1.00 MINUTES 
 
           Moved by Jangula and seconded by Presley that the minutes of the regular Council meeting held February 2, 2009 adopted.

4.00  COMMITTEE/STAFF REPORTS
 
Bylaw Fines
            Moved by McRae and seconded by Presley that “Prevention of Public Nuisances Amendment Bylaw No. 2565, 2009” proceed to 1st, 2nd and 3rd reading; and
 
That the following resolution be forwarded to the AVICC and UBCM conventions:
 
Whereas municipalities lack the legislative tools to adequately deal with certain types of problem properties and the collection of outstanding municipal fines;
 
Therefore be it resolved that the Government of British Columbia amend the Community Charter to provide municipalities other methods of collecting outstanding MTI tickets including applying outstanding fines to property taxes.

Casa Loma Seniors Village Legal Documents       
            Moved by Presley and seconded by Theos  that Council approve the legal documents for the development of Lot 1, Section 17, Comox District, Plan 81094 and;
 
That the Mayor and Manager of Corporate Administration be authorized to sign all documentation relating to this development.

5.00  REPORTS AND CORRESPONDENCE FOR INFORMATION
 
Heritage Minutes
            Moved by Presley and seconded by McRae that the Heritage Advisory Commission minutes of January 28, 2009 be received for information.

6.00  RESOLUTIONS OF COUNCIL
 
Incamera Meeting
            Moved by Presley and seconded by Theos that under the provisions of Section 90(1)(k) of the Community Charter, notice is hereby given that a Special In-Camera meeting closed to the public, will be held February 9, 2009 at the conclusion of the Regular Council Meeting.

8.00  NOTICE OF MOTION
 
Rails with Trails
            At the next Council meeting, Councillor Leonard will bring forward a resolution for presentation to AVICC regarding Rails with Trails along the E & N Corridor. 
  
10.00  BYLAWS 
 
Bylaw No. 2565 Public Nuisance
             Moved by McRae and seconded by Jangula that “Prevention of Public Nuisances Amendment Bylaw No. 2565, 2009” pass first, second  and third reading.

11.00  COUNCIL MEMBER ROUNDTABLE
 
 
Councillor Presley defended the Economic Development Society’s role in the Comox Valley in response to a letter in the newspaper recently submitted by Barry Minaker.
 
Mayor Phelps outlined his participation in the 50th anniversary of the curling club.

 
12.00   ADJOURNMENT
 
            Moved by Theos and seconded by Presley the meeting now adjourn at 4:18 p.m.
