Minutes of a Regular Council Meeting held in the City Hall Council Chambers, Courtenay B.C., on Monday, January 21, 2008 at 4:00 p.m.

           Moved by Phelps and seconded by Presley hat the minutes of the regular Council meeting held January 14, 2008 be adopted.

2.00  LATE ITEMS
 
Mayor Winchester approved the addition of one late item to the agenda.
 
3.00  DELEGATIONS
 
Public Submissions regarding Business Licence Bylaw No. 2523, 2008 and Second Hand Dealers Bylaw No. 2524, 2008
 
Laura Nelson of Coast Furniture expressed concerns regarding sections 2.6, 2.7, 2.10, and 2.11 of the Second Hand Dealers Bylaw relating to her business.
 
Dave Slobodan advised that Coast Furniture would be exempt from the bylaw.
 
 4.00  COMMITTEE/STAFF REPORTS
 
.01 C.V. Cycling Task Force 6940-01

            Moved by Leonard and seconded by Phelps that Council approve the Comox Valley Cycling Plan dated December 2007 as attached – Schedule No. 1;
 
That Council approve the implementation strategy outlined in the Comox Valley Cycling Plan;
 
That Council direct the Director of Community Services to appoint the appropriate staff to the Cycling Technical Committee; and
 
That Council direct staff to begin implementing the recommendations outlined in the Comox Valley Cycling Plan within the financial planning framework of each jurisdiction.

.02 Cycling Infrastructure Partnership Program 6940-20

            Moved by Presley and seconded by Leonard that Council  approve an application to the Ministry of Transportation pursuant to the Cycling Infrastructure Partnership Program 2008-2009 for funding assistance to construct a 3 metre wide asphalt bikeway on the McDonald Road right-of-way starting at Lerwick Road running east to Hector Road being a distance of approximately 0.4 kilometres at an estimated cost of $99,500.00 with the City’s portion being $49,750.00.

            Moved by Theos and seconded by Leonard that notice be given to the adjacent property owners of the requested development variance permit and that the application be returned to Council at the regular scheduled meeting on February 4, 2008; and
 
That subject to public input, Development Variance Permit No. 0802 be issued to Matthew Knott and Lawrence Berry, to provide relief from the City of Courtenay Subdivision Control Bylaw No. 1401, 1096 and amendments thereto, to permit Oakridge Drive and Island Highway (Hwy 19A), adjacent to the subject property to remain a rural road standard as outlined in Schedule No. 1, for Lot 2, Plan 18219, and Lot B, Plan 9719, both of Section 18, Comox District.

            Moved by McRae and seconded by Presley that the 2007 Year End Building Permit Report be received for information.

5.00 REPORTS AND CORRESPONDENCE FOR INFORMATION
 
.01 Letter from Minister Chong 470-20

            Moved by Phelps and seconded by Presley that the letter dated January 10, 2008 from Minister Ida Chong responding to a letter from Mayor Winchester regarding an update on progress the City has made in regard to the creation of the new Comox Valley Regional District be received for information.

6.00  RESOLUTIONS OF COUNCIL
 
.01 Incamera Meeting
 
            Moved by Presley and seconded by Phelps that under the provisions of Section 90(1)(i) of the Community Charter, notice is hereby given that a Special In-Camera meeting closed to the public, will be held January 21, 2008 at the conclusion of the Regular Council meeting.

.01 DVP and subdivsion application Sandy Gray 325 Johnston Ave
 
            Moved by McRae and seconded by Leonard that the letter from Sandy T. Gray, City Administrator regarding the subdivision application and DVP for property located at 325 Johnston Avenue be received for information.

10.00  BYLAWS
 
.01 Bylaw No. 2523 Business Licence

            Moved by Presley and seconded by McRae that “Business Licence Bylaw No. 2523, 2008” be finally passed and adopted.

.02 Bylaw No. 2524 Second Hand Dealers

            Moved by McRae and seconded by Presley that “Second Hand Dealers Bylaw No. 2524, 2008” be finally passed and adopted.
Carried
 
Staff were directed to review the $200 fine for contravention of section 2.9 of the bylaw and to draft a bylaw amendment for an increased fine.
 
.03 Bylaw No. 2520 Fees and Charges

            Moved by Theos and seconded by Presley that “City of Courtenay Fees and Charges Amendment Bylaw No. 2520, 2008” be finally passed and adopted.
Carried with Councillor Jangula opposed
