Acting Mayor McRae approved the addition of three late items.
3.00 DELEGATIONS
Judy Hagen and Julie Fortin, Heritage Advisory Commission
Judy Hagen and Julie Fortin gave a presentation on the Heritage Conference recently held in North Vancouver.
Garry Steele, Eau Claire Properties re: 190 Powerhouse Road
Garry Steele, Eau Claire Properties reviewed the proposed development for a 92 unit single family residential small lot bareland strata subdivision at Arden and Powerhouse Road.

DVP NO. 0713 BAKER
Moved by Theos and seconded by Presley that notice be given to the adjacent property owners of the proposed development variance outlined below and that the application is returned to Council at a meeting on August 7, 2007;
That subject to public input, Development Variance Permit No. 0713 be issued to Tim and Janice Baker to provide relief from the City of Courtenay Zoning Bylaw No. 2500, 2007, and amendments thereto, to reduce the required watercourse setback from the natural boundary of Puntledge River from 30 metres to 12 metres to allow for the renovation and addition of a sundeck as shown on Schedule No. 1, for the property legally described as Lot 3, Section 118, Comox District, Plan 41256 at 1075- 1st Street;
That if the permit holder has not substantially commenced any construction to which the permit was issued within twelve (12) months after the date it was issued, the permit lapses.

Moved by Presley and seconded by Leonard that Council deny the application from Eau Claire Properties for an Official Community Plan Amendment and Rezoning for the property legally described as Lot 8, except part in Plan 40343, and Lot 8, except part in Plan 40343, and Lot 3, Both of District Lot 155, Comox District, Plan 1241.

BOUNDARY EXTENSION SOUTH COURTENAY
Moved by Jangula and seconded by Presley that Council requests the Minister of Community Services to recommend the extension of the Boundary of the City of Courtenay to include the parcels south of the current City Boundary as shown on Schedule No. 1.

RETIREMENT CONCEPTS
Moved by Leonard and seconded by Jangula that the application from Derek Crawford Architect Inc. for Development Permit No. 0709 to amend Development Permit No. 0605 for the construction of a 232 unit seniors care complex on the remainder of Lot 9, Section 17, Comox District, Plan 3015 at 4640 Headquarters Road, to change the roof material from metal roof tiles to fibreglass/asphalt singles and substitute the originally specified vinyl siding with Hardy Plank siding be approved.
That if the permit holder has not substantially commenced any construction to which the permit was issued within twelve (12) months after the date it was issued, the permit lapses.

Moved by Jangula and seconded by Leonard that Council approve the application for the strata conversion of 1160-14th Street and direct the Mayor and Manager of Corporate Administration to sign the Strata Plan mylars when provided.

CONTRACT
Moved by Presley and seconded by Leonard that Council grant approval in principle to the 2008/09 Municipal Contract Policing Resource request in the amount of $3,438,309 representing 90% of the contract cost for an established strength of 26.40 members.

Acting Mayor McRae asked if there was any public input and there was none.
Moved by Theos and seconded by Leonard that Development Variance Permit No. 0706 be issued to KCM (2000) Developments Ltd. to provide relief from Zoning Bylaw No. 2500, 2007 and amendments thereto, to reduce the side yard setback from 4.5 metres to .75 metres for a phased strata development as detailed in Schedule No. 1 for the property legally described as Strata Lots 56/57, Block 72, Comox District, Plan VIP6195 at #361/363 3399 Crown Isle Drive.

Acting Mayor McRae asked if there was any public input and there was none.
Councillor Presley declared a potential conflict of interest due to a client relationship and vacated the Chambers at 4:46 p.m.
Moved by Theos and seconded by Leonard that Development Variance Permit No. 0707 be issued to Crossman Homes Ltd. to provide relief from Zoning Bylaw No. 2500, 2007 and amendments thereto, to reduce the rear yard setback from 9 metres to 8.5 metres for the construction of a single residential dwelling as detailed in Schedule No. 1 & 2 for the property legally described as Lot 32, District Lot 231, Comox District, Plan VIP81438 at 1044 Hornby Place.

LIBRARY BOOK RATE PETITION
Moved by Leonard and seconded by Presley that Council send a letter to Catherine Bell, MP supporting Bill C458 and protection of Canada's public libraries' access to concessionary postal rates for library material.

BC GREEN BUILDING CODE
Moved by Leonard and seconded by Theos that Council direct staff to contribute to the development of the provincial Green Building Code to ensure it reflects our local conditions and to seek a staff report to provide a framework on how we can begin to encourage green building alternatives.

HOUSE OF COMMONS PRE BUDGET
Moved by Leonard and seconded by Presley that Council direct staff to prepare a written submission to the House of Commons Finance Committee for its annual pre-budget consultation being held in Victoria, BC on October 3, 2007 and that the written submission be presented prior to the deadline of August 15, 2007.

Moved by Leonard and seconded by Presley that the letter from Minister Ida Chong concerning proposed structure changes to the Comox Strathcona Regional District be received for information.
