July 3, 2007 Council Meeting Minutes

Minutes of a Regular Council Meeting held in the City Hall Council Chambers, Courtenay B.C., on Tuesday, July 3, 2007 at 4:00 p.m.

The meeting was called to order at 4:01 p.m.

Mayor Winchester extended a sincere appreciation to Edwin Grieve and Councillor Jangula for their hard work in coordinating the July 1st festivities.

Mayor Winchester read out a press release announcing the retirement of the Fire Chief, Terry Towle. His retirement is effective October 1, 2007.

Moved by Jangula and seconded by Presley that the minutes of the regular Council meeting held June 18, 2007 and the Committee of the Whole minutes of June 25, 2007 be adopted.

3.00 DELEGATIONS

Greg Peterson, re: Outdoor Flea Market

Greg Peterson representing the local outdoor flea market expressed his disappointment that the City will not allow him under the current zoning to continue to hold an outdoor flea market every Sunday at the back parking lot of Upper Island Motors. They were forced to move their location from the Courtenay Hotel parking lot. He stressed that this had been a long time Sunday tradition and the seniors truly enjoy attending. There have never been any problems since he has been organizing it since 1992. He asked Council to please reconsider and allow them to continue to hold their outdoor flea market.

Moved by Leonard and seconded by Theos that the report on the Pesticide Awareness Open House be received for information.

Moved by Leonard and seconded by Phelps that the City of Courtenay allocate up to $2,500.00 towards the Comox Valley Cycling Task Force Committee.

DVP NO. 0706 KCM (2000)DEV LTD
Moved by Theos and seconded by Presley that notice be given to the adjacent property owners of the proposed Development Variance Permit and that the application be returned to Council at a meeting on July 16, 2007;

That subject to public input, Development Variance Permit No. 0706 be issued to KCM (2000) Developments Ltd. to provide relief from Zoning Bylaw No. 2500, 2007 and amendments thereto, to reduce the side yard setback from 4.5 metres to .75 metres for a phased strata development as detailed in Schedule No. 1 for the property legally described as Strata Lots 56/57, Block 72, Comox District, Plan VIS6195 at #361/363 - 3399 Crown Isle Drive.

Councillor Presley declared a potential conflict of interest due to client relationship and vacated the Chambers at 4:12 p.m.

Moved by Leonard and seconded by Theos that notice be given to the adjacent property owners of the proposed Development Variance Permit and that the application be returned to Council at a meeting on July 16, 2007;

That subject to public input, Development Variance Permit No. 0707 be issued to Crossman Homes Ltd. to provide relief from Zoning Bylaw No. 2500, 2007 and amendments thereto, to reduce the rear yard setback from 9 metres to 8.5 metres for the construction of a single residential dwelling as detailed in Schedule No. 1 & 2 for the property legally described as Lot 32, District Lot 231, Comox District, Plan VIP81438 at 1044 Hornby Place.

Councillor Presley returned to the Chambers at 4:14 p.m. and took his seat.

STREET NAMES HARRISON 
Moved by Jangula and seconded by Presley that the name Harrison not be placed on the street names reserve list, and
That the Director of Operational Services write to the applicant with regrets and advise that this name exists on the Ministry of Transportation road name list and cannot be duplicated on the City's street name list.

 Moved by Phelps and seconded by Presley that the Heritage Advisory Commission minutes of June 20, 2007 be received for information.

7.00 UNFINISHED BUSINESS

MISSION VENTURES HAVARAT HOLDINGS 
Mayor Winchester asked if there was any public input and there were none.

Moved by Presley and seconded by Jangula that Development Permit No. 0708 be issued to allow the construction of a 91 unit hotel building on the lands currently comprising of 2160, 2200 and 2210 Cliffe Avenue, including landscape materials and installation, and irrigation valued at $55987.85, as illustrated in Schedule Nos. 1-4 including the following height variance to Zoning Bylaw 2500, 2007;

(a) To increase the mean height from 9.6 metres to 11.94 metres;

That issuance of a permit for Development Permit Application 0708 be subject to:

(a) finalization of a storm water management plan, architectural, and landscape plans, incorporating all staff comments outlined in the report and to the satisfaction of the Director of Planning Services, Director of Regulatory and Property Services and the Director of Operational Services;
(b) consolidation of the subject lands into a single parcel;
(c) registration of a Statutory Right of Way in favour of the City for Mile of Flowers irrigation along Cliffe Avenue;


That the Mayor and Manager of Corporate Administration be authorized to execute a Statutory Right of Way in favour of the City for Mile of Flowers irrigation along Cliffe Avenue; and

That if the permit holder has not substantially commenced any construction to which the permit was issued within twelve (12) months after the date it was issued, the permit lapses.

YELLOW RIBBONS ON CITY VEHICLES
Moved by Jangula and seconded by Phelps that staff coordinate the placement of yellow ribbons on City vehicles to support our troops.

OUTDOOR FLEA MARKET

Moved by Leonard and seconded by Jangula that staff immediately start the process to complete a temporary commercial permit for Greg Peterson to hold an outdoor flea market every Sunday and that notice of this temporary permit be given before the July 16, 2007 Council meeting.

PESTICIDE

Moved by Phelps and seconded by Presley that the issue surrounding pesticide use be referred to the Agricultural Committee.
Motion Defeated

Moved by Jangula and seconded by Leonard that "Pesticide Use Bylaw No. 2504, 2007" be finally passed and adopted.
Carried with Councillor Phelps opposed
