Minutes of a Regular Council Meeting held in the City Hall Council Chambers, Courtenay B.C., on Monday, May 22, 2007 at 4:00 p.m.

The meeting was called to order at 4:02 p.m.

Moved by Phelps and seconded by Leonard that the minutes of the regular Council meeting held May 14, 2007 be adopted.
Carried

Mayor Winchester announced that Captain Lane MacDonald (retired) of the Courtenay Volunteer Fire Department was presented with the Trainer of the Year award at the B.C. Fire Training Officers Education Workshop held in Courtenay May 13-18.

2.00 LATE ITEMS

Mayor Winchester approved the addition of two late items to the agenda.

3.00 DELEGATIONS

Community Drug Strategy Committee Update

Councillor Phelps provided an overview of the Community Drug Strategy Committee activities in 2006/2007 as well as future planned events.

Karae White , Comox Valley Head Injury Society

Karae White of the Comox Valley Head Injury Society reviewed the “Team Terrific” educational program regarding the prevention of brain injuries, which is presented at the local schools.

Moved by Phelps and seconded by Presley that June 2007 be declared “Brain Injury Awareness Month” in the City of Courtenay.

REPEAL MUTUAL AID BYLAWS 7200-20
Moved by Presley and seconded by Jangula that “Mutual Aid Agreements Repeal Bylaw No. 2498, 2007 proceed to first, second and third reading.

NORTHGATE FOURSQUARE CHURCH 3360-20

Moved by McRae and seconded by Jangula that Council deny the request from Northgate Foursquare Church to waive fees, charges and taxes and to amend the Tree Management and Protection Bylaw by removing the significant tree designation at 1640 Burgess Road for a 16 unit housing project on Cumberland Road.
Carried with Councillor Theos opposed

GLACIER VIEW TRAFFIC CALMING 0360-20

Moved by Phelps and seconded by Jangula that the Report from the Glacier View Neighbourhood Traffic Calming Group be accepted;

That the list of Recommendations and Financial Implications be approved by the City: and

That the list of traffic calming devices are installed in priority order, up to a maximum of $40,000 for 2007.

Subsidiary Motion

Moved by Jangula and seconded by Presley that the City perform a review of the Dingwall Road/McLauchlin Drive intersection over the next six months and provide any further recommendations to Council.

NOTICE ON TITLE 3100 KLANAWA CRES 3800-02

Moved by Theos and seconded by Leonard that pursuant to Section 57(3) of the Community Charter, Council direct the Corporate Officer to file notice in the Land Title Office against Lot 1, District Lot 236, Comox District, Plan VIP79454 located at 3100 Klanawa Crescent stating that:

(a) A Council resolution relating to that land has been made under this section; and
(b) further information about it may be inspected at the offices of the Municipality.

6.00 RESOLUTIONS OF COUNCIL

ZONING BYLAW – EXOTIC DANCERS
Moved by Jangula and seconded by Phelps that the Director of Planning Services be directed to prepare a bylaw to amend Zoning Bylaw No. 2500, 2007 in respect of licenced premises in order that Council may consider regulation, restriction or prohibition in either or both the C-1 and C-2 zones of performances, shows and exhibitions which involve exotic and sexually explicit dance and dancers, including without limitation, striptease, lap dancing and pole dancing.

9.00 NEW BUSINESS

PORT ALBERNI ALTERNATE ROUTE

Moved by McRae and seconded by Presley that the letter from Alberni-Clayoquot Regional District requesting support for a second route between Port Alberni and Highway 19 be received for information; and

That staff request further details regarding the proposed new route.

SEAL PREDATION

Moved by Leonard and seconded by McRae that Council request the Department Fisheries and Oceans to play a lead role in the completion of an estuary management plan with a copy of the request to Catherine Bell, MP.

BUILDING HEIGHT RESTRICTIONS

Moved by McRae and seconded by Leonard that staff provide a report to Council regarding seeking public input on the concept of permitting the construction of buildings in the City greater than 4 stories in height.

Moved by McRae and seconded by Presley that “Mutual Aid Agreements Repeal Bylaw No. 2498, 2007” pass first, second, and third reading.

11.00 COUNCIL MEMBER ROUND TABLE 

Councillor Leonard outlined her attendance at the following events:

- Cycling Task Force Meeting
- C.V. Growth Management meeting
- C.V. Environmental Council meeting
- Barbeque Fundraiser at the Public Works Yard 
 

Councillor Jangula outlined his attendance at the opening of the new L’Arch Society building.

Councillor Phelps reviewed his attendance at the Victoria Day Parade

Councillor McRae reviewed his attendance at the following events:
- C.V. Growth Management meeting
- 54th Anniversary of the Ladies of the Royal Purple
- 12th Annual Highland Games

Councillor McRae thanked the Courtenay and Comox Fire Departments for making emergency preparedness kits available to the public.

Councillor Theos reviewed his attendance at the “Valley Idols” final.

Mayor Winchester outlined her attendance at the following events:
 - Opening ceremonies for the British Columbia Fire Training Officer’s Annual Workshop. A letter of thanks will be sent to the Courtenay Volunteer Fire Department for hosting this successful event.
- School District #71 meeting regarding potential school closures
- Victoria Day Parade in Cumberland
