Minutes of a Regular Council Meeting held in the City Hall Council Chambers, Courtenay B.C., on Monday, November 5, 2007 at 4:00 p.m.

The meeting was called to order at 4:00 p.m. 

1.00 MINUTES 
 
           Moved by Presley and seconded by Phelps that the minutes of the regular Council meeting held October 15, 2007 and Committee of the Whole minutes of October 29, 2007 be adopted.
Carried 

Mayor Winchester introduced the new Fire Chief, Don Bardonnex and welcomed him to the City of Courtenay.
 
4.00 COMMITTEE/STAFF REPORTS
 
.01 December Meetings 570-01
 
             Moved by McRae and seconded by Theos that the Council meeting scheduled for December 3, 2007 and the Committee of the Whole meeting scheduled for December 31, 2007 be cancelled.

.02 Rezoning Application Silverado Land Corp 3360-20-0711
 
            Moved by Presley and seconded by Theos that Council approve the application from Silverado Land Corp. to rezone Lot 1, Plan 82600 on Monarch Drive from PA-1 to CD-1B to allow for one duplex only with a lot area not less than 0.157 ha.;
 
That Zoning Amendment Bylaw No. 2514, 2007 proceed to 1st and 2nd reading; and
 
That a Public Hearing be held on November 19, 2007 at 5:00 p.m. in City Hall Council Chambers.

.03 DVP no. 0709 C.V. Curling Club 3090-20-0709
 
            Moved by Theos and seconded by Phelps  that notice be given to the adjacent property owners of the proposed development variance outlined below and that the application be returned to Council at their meeting on November 19, 2007; and
 
That subject to public input, Development Variance Permit No. 0709 be issued to the Comox Valley Curling Club to provide relief from Section 8.28.7 of the City of Courtenay Zoning Bylaw No. 2500, 2007, and amendments thereto, to reduce the right side yard setback from 15.0 metres to 5.08 metres as detailed in Schedule No. 3 for a new boiler room and vestibule with an area of 16.35m2 for the property legally described as Lot A, Section 18, Comox District, Plan 12735.

.04 Zoning Amendment Text Changes 3360-20-0710
 
            Moved by McRae and seconded by Leonard that Council approve amending the City of Courtenay Zoning Bylaw No. 2500, 2007 by making text amendments for home occupation use, personal service use and enclosed storage facilities;
 
That “Zoning Amendment Bylaw No. 2513, 2007 proceed to 1st and 2nd reading; and
 
That pursuant to Section 890(4) of the Local Government Act, the public hearing be waived.

.05 Courtenay Hotel Palace Theatre
 
Dave Slobodan, Director of Regulatory and Property Services gave a PowerPoint presentation on the status of the Courtenay Hotel and Palace Theatre.  The hotel and adjacent building will be demolished in the next couple of weeks and the process should take four to six weeks.  The structural damage to the theatre is quite severe and the potential for it to collapse under a heavy snow fall is likely.  The owners of the theatre are working with their insurance company, but saving the whole structure is unlikely, however they may attempt to save the section facing 5th Street.

            Moved by Phelps and seconded by Presley that the Heritage Advisory Commission meeting minutes of September 26, 2007 be received for information.

            Moved by Phelps and seconded by Leonard that notice of the Annual Community Drug Strategy Committee Public Forum to be held on November 27, 2007 be received for information.

.01 Incamera Meeting
 
            Moved by Presley and seconded by McRae that under the provisions of Section 90 (1)(k) of the Community Charter, notice is hereby given that a Special In-Camera meeting closed to the public, will be held November 5, 2007 at the conclusion of the Regular Council Meeting.

            Moved by McRae and seconded by Jangula that “Zoning Amendment Bylaw No. 2513, 2007” pass first and second reading.

            Moved by Theos and seconded by Presley that “Zoning Amendment Bylaw No. 2514, 2007” pass first and second reading.
