Moved by McRae and seconded by Phelps that the minutes of the regular Council meeting held September 17, 2007 be adopted.

4.00 COMMITTEE/STAFF REPORTS
.01 DP Amendment 0715 Mission Ventures 3060-20-0715
Moved by Phelps and seconded by McRae that the application for Development Permit Amendment 0715 be referred to the Council meeting scheduled for October 9th, 2007.
Carried with Councillor Leonard opposed
.02 DP Amendment 0424/0523 Royal Place/Bristol Way 3060-20-0424/0523
Moved by Theos and seconded by McRae that notice be given to adjacent property owners on Monarch Drive of a proposed change to the development permits outlined below and that the application be returned to Council on October 15, 2007; and
That the application from the residents of the strata units of Lot A, VIP79916 to amend Development Permit No.’s 0424/0523 to remove the requirement for fixed opaque windows on the second storey of the residential units facing the adjacent single residential units on Monarch Drive be approved.

.03 DVP no. 0715 Kuranda Invest 3090-20-0715
Moved by McRae and seconded by Leonard that notice be given to the adjacent property owners of the proposed development variance outlined below and that the application be returned to Council at its meeting on October 15, 2007; and
That subject to public input, Development Variance Permit No. 0715 be issued to Kuranda Investments Ltd. to provide relief from the City of Courtenay Sign Bylaw No. 2459, 2006, and amendments thereto, to reduce the required frontage for installation of a freestanding sign from 30.0 metres to 23.68 metres as detailed in Schedule No. 1 for the property legally described as Lot B of Strata Plan VIS4567, District Lot 230, Comox District, Plan 37179.

Moved by Jangula and seconded by McRae that Council approve adding the definition of “household” to Division 3, Part 1 of Zoning Bylaw 2500, 2007;
That “Zoning Amendment Bylaw No. 2512, 2007” proceed to 1st and 2nd reading; and
That a Public Hearing be held on October 15, 2007 at 5:00 p.m. in the City Hall Council Chambers in relation to Bylaw No. 2512, 2007.

.05 Notice Against Title-1075 1st st 3800-20
Moved by Theos and seconded by Phelps that pursuant to Section 57(3) of the Community Charter, Council direct the Corporate Officer to file notice in the Land Title Office against Lot 3, Section 118, Plan 41256, except Plan VIP55602 located at 1075 1st Street stating that:
(a) a Council resolution relating to that land has been made under this section; and
(b) further information about it may be inspected at the offices of the Municipality.

.06 City Property Leases 2380-20
Moved by McRae and seconded by Leonard that subsequent to publication of notice, Council approve the attached leases for municipal owned property at 656 Arden Road, 210 Anderton Avenue and 2390 Lake Trail Road.
That the Mayor and Manager of Corporate Administration be authorized to execute the leases on behalf of the City.

Moved by Leonard and seconded by Phelps that the report from the Director of Operational Services regarding the maintenance of oil/grit interceptors in the City be received for information.

Moved by McRae and seconded by Leonard that “Zoning Amendment Bylaw No. 2512, 2007” pass first and second reading.

Moved by Theos and seconded by Leonard that “Tax Exemption 2008 Bylaw No. 2510, 2007” be finally passed and adopted.

Moved by Jangula and seconded by McRae that “Churches Tax Exemption 2008 Bylaw No. 2511, 2007” be finally passed and adopted.

Councillor Phelps reviewed his attendance at the Cops for Cancer Tour de Rock Red Surge Dinner at Crown Isle.
Councillor Leonard reviewed her attendance at Vancouver Island Regional Library Board meetings.
Councillor Theos reviewed his Scooter tour with John Higginbotham.
Mayor Winchester reviewed her attendance at the UBCM Annual Convention.
