Minutes of a Regular Council Meeting held in the City Hall Council Chambers, Courtenay B.C., on Monday, October 19, 2009 at 4:00 p.m.

           Moved by Leonard and seconded by Ambler that the minutes of the Regular Council meeting held October 13, 2009 be adopted.

4.00  COMMITTEE/STAFF REPORTS
 
True Sport Community
 
            Moved by Theos and seconded by Leonard that the City of Courtenay declare itself a “True Sport Community”, joining over 1,500 other True Sport communities, organizations, clubs, leagues, and teams across Canada.

Olympic Torch Relay Update

            Moved by Jangula and seconded by Theos that the report from the Director of Community Services regarding the Vancouver 2010 Olympic Torch Relay be received for information.

South Courtenay Neighbourhood Park

            Moved by Theos and seconded by Leonard that the concept plan for the south Courtenay neighbourhood park located at Hornby Place and Galloway Place be approved.

Notice on Title 594 Washington Cres

            Moved by Leonard and seconded by Theos that pursuant to section 57(3) of the Community Charter Council direct the Corporate Officer to file a notice in the Land Title Office against the property located at 594 Washington Crescent:
 
(a)        a resolution relating to the lands has been made under section 57 of       the Community Charter, and
(b)        further information about it may be inspected at the municipal hall.

Building Activity Report Sept 09

            Moved by Theos and seconded by Ambler that the Building Activity Report for September 2009 be received for information.

Development Permit No. 0922 825 cliffe ave

            Moved by Ambler and seconded by Jangula that Development Permit No. 0922, for a façade change to an approximately 600m2 commercial building located at 825 Cliffe Avenue (Lot 1, Section 61, Comox District, Plan 30741), be issued subject to the following conditions:
 
a.  In advance of a final building inspection the owner must enter into an encroachment agreement with the City, to the satisfaction of the City, for any portion of the building that will encroach over the property line adjacent to Cliffe Avenue, and register this agreement on title;
b.  Development must be in conformance with the plans, elevations, sign specifications, and sign illumination contained in Attachment No. 2-6;
c.  Installation of landscape planters and a bike rack as shown on the plan  contained in Attachment No. 2;
d.  Issuance of a sign permit in compliance with the City of Courtenay Sign  Bylaw No. 2042 is required for all signage;
e.  All exterior building lighting, including any sign lighting must be Full Cut Off/Flat Lens luminaries, consistent with City policy #5240.00.01  (the Dark Skies policy) and all lighting must be approved by the City prior to installation;
f.   That if the permit holder has not substantially commenced any  construction to which the permit was issued within twelve (12) months after the date it was issued, the permit lapses; and
 
That Council authorize the signatories of the City to execute the Encroachment Agreement.

6.00  RESOLUTIONS OF COUNCIL

            Moved by Leonard and seconded by Jangula that under the provisions of Section 90(1)(e)(k) of the Community Charter, notice is hereby given that a Special In-Camera meeting closed to the public, will be held October 19, 2009 at the conclusion of the Regular Council Meeting.

7.00  UNFINISHED BUSINESS
 
Development Variance Permit No. 0909 Quality Foods Sign9
 
            Moved by Theos and seconded by Jangula that Development Variance Permit No. 0909, to vary Section 6.4.1 of the City of Courtenay Sign Bylaw No. 2042, 1998 the maximum total area for fascia signs per building face of a business premise, from 9m2 to 34.4m2 for the property legally described as Lot A, Section 66 & 67, Comox District, Plan 44811 Except Part in Plans 49234, VIP66865 and VIP68598 (2701 Cliffe Avenue), be issued, subject to development in accordance with the plans and elevations contained in Attachment No. 2.

Councillor Jangula reviewed his attendance at the following events:

- Regional Solid Waste Committee meeting
 
Mayor Phelps reviewed his attendance at the following events:
- Regional Hospital Board meeting
- Courtenay River heritage plaque dedication
- Comox Valley Community Foundation dinner with Councillors
 
The meeting recessed at 4:38 to conduct the Public Hearing in relation to Zoning Amendment Bylaw No. 2592, 2009.
 
The meeting reconvened at 5:05 p.m.
 
11.00  BYLAWS

Bylaw no. 2592 Zoning Amendment
            Moved by Jangula and seconded by Leonard that “Zoning Amendment Bylaw No. 2592, 2009” pass third reading.
