Sidewalk Patios

The Downtown Sidewalk Patio program allows restaurants and cafés in the Downtown Courtenay Business Improvement Area to expand their seating onto public sidewalks and parking stalls. This program operates seasonally from April 1 to October 31 each year.

Applying for a sidewalk patio

To participate, businesses must submit a Sidewalk Patio application form and comply with the Sidewalk Patio policy [PDF - 517 KB], which outlines safety, accessibility and design requirements.

Key requirements

  • A Licence of Occupation is required for all sidewalk patios.
  • Businesses must provide $5 million in liability insurance, with the City named as an additional insured.
  • A valid business licence and, if applicable, liquor licence is required.
  • Patios must not obstruct fire hydrants, pedestrian walkways, loading zones or intersections.
  • Businesses can use up to two parking stalls for a patio.
  • Temporary walkways may be required if the patio extends onto a parking stall.

Fees

  • $125 seasonal licence fee (April 1 to October 31) or $25 per month
  • $5 per square metre annually for sidewalk use
  • $100 per parking space occupied annually

Patio design and maintenance

  • Patios must be kept clean and well-maintained.
  • Fencing or railings are required to separate patios from roadways and walkways.
  • Signage and advertising are not permitted in patio areas.
  • All patios must be removed by October 31.
