Board of Variance

The Board of Variance reviews appeals for minor zoning variances when following the zoning regulation bylaw would cause undue hardship. It also considers applications related to additions and structural changes to non-conforming buildings.

The board is made up of volunteer members appointed by City Council. Elected officials and City staff cannot serve on the board. 

The board cannot:

  • Change land use or density limits.
  • Approve developments that negatively impact the natural environment.
  • Approve changes that significantly affect neighbouring properties.

Applying for a zoning variance

You can apply for a variance to the Board of Variance if following a zoning rule about the location, size or dimensions of a building or structure would cause undue hardship.

  1. Review zoning regulations
    Check the interactive zoning map and Zoning Bylaw to see the current zoning regulations that apply to your property and identify which ones you want to relax. The review of your proposal follows procedures outlined in Board of Variance Bylaw No. 1697, 1994 [PDF - 2.5 MB] and conforms to other relevant guidelines.
  2. Read the application guidelines
    Review the Board of Variance application guidelines (included on the application form) to understand the process and submission requirements. 
  3. Discuss or meet with Planning staff
    Contact Planning staff to discuss your proposal. When you have prepared sufficient information for review, staff will arrange a meeting to discuss your proposal with you, including requirements, fees and policies.
  4. Submit your application
    Once you have completed your application and compiled all required documents, contact Planning staff for a final review and to receive a link to upload your documents. You will also receive instructions on application fees and payment methods.
