A development variance permit (DVP) allows exceptions to certain zoning, subdivision, sign or other bylaw regulations. It cannot change land use, density or floodplain specifications. Most DVPs apply to setback or height adjustments. The permit is granted for a specific purpose, and the development must follow the approved specifications.
Applying for a development variance permit
Access the development variance permit application form and guidelines [PDF/326KB]. The application process is outlined below:
Research
- Identify the bylaw regulations you want to vary (e.g. zoning or sign bylaws). A DVP cannot change land use or density. (Zoning amendments are required for that. See the Zoning Bylaw page for more information.)
- Check applicable guidelines and policies, including:
- Official Community Plan (OCP) policies that influence DVP approvals. See the development standards policies guide [PDF/314KB] for more information.
- Development Permit Area (DPA) requirements if the property is near environmentally sensitive areas, steep slopes or agricultural land, or requires a form and character Development Permit. View the development permits page for more information.
- K’ómoks First Nation Cultural Heritage Investigation Permit (CHIP) is needed for some areas near watercourses or with high archeological potential. Contact K’ómoks First Nation at 250-339-4545 ext. 112, or visit their website.
- Engineering specifications related to frontage improvements or servicing upgrades.
- Prepare a detailed proposal description.
- Review Schedule D of the Development Procedures Bylaw No. 3106, 2023.
Discuss with planning staff
- Contact Planning staff to discuss your proposal.
- When you have prepared sufficient information for review, staff will arrange a meeting to discuss your proposal with you, including requirements, fees and policies.
Prepare your application
- Read the development variance permit application form and guidelines [PDF/326KB].
- Complete and compile required documents.
Submit your application
- Once you have completed your application and compiled all required documents:
- Contact Planning staff for a final review. You will also receive a link to upload your documents along with instructions on application fees and payment methods.
Referrals
- Staff send your application to relevant City departments and external agencies for review.
- Additional information may be required before proceeding.
Community information meeting (if required)
- The City may ask you to host a community information meeting before Council considers your application. This is based on the Development Procedures Bylaw No. 3106, 2023
Council or Delegate review and public notice
- Staff prepare a report for the Delegate (Minor DVP) or City Council (Regular DVP).
- If required, public notices are sent to neighbours for comments and staff compile public comments for inclusion in the report.
- When Council is the decision-maker, the applicant is encouraged to attend the Council meeting where they may approve, deny, request more information, or place conditions on the permit.
- A Notice of Permit is registered against the property title at the Land Title Office.
