The City of Courtenay regulates the addition and removal of soil fill on any property through the Soil Fill and Replacement Bylaw [PDF/173KB]. Work involving soil fill or removal must comply with this bylaw and any other applicable City regulations.
Before starting any soil removal or placement work, check Section 6 of the bylaw to determine whether you need a permit.
Permit application requirements
To submit a soil removal or fill permit applications, download and complete an application form and email it to development@courtenay.ca.
You must include the following documents with your application:
- Schedule B-1 and/or B-2
- Schedule D-1 and/or D-2, which must include plans and specifications as required under Clauses 7 and 8 of Schedules B-1 and B-2, as well as Section 8 of the bylaw. These must be prepared and sealed by a qualified professional.
- Schedules E-1 and/or E-2 (partially filled)
Incomplete applications will not be processed.
Exemptions from the bylaw
A permit is not required if the soil removal or placement is:
- Part of road construction, including improvements, repair or maintenance.
- Conducted by a government authority, including work on municipally owned lands and parks.
- Necessary for an approved building permit.
- Part of a subdivision servicing agreement.
