Subdivision and Development Servicing Bylaw

This bylaw regulates the provision of infrastructure services in connection with new subdivisions and developments in the City of Courtenay. It ensures that developments are designed and constructed in a way that supports safe, sustainable growth while protecting the City’s infrastructure.

  • Required Works & Services: Developers are responsible for installing or upgrading roads, sidewalks, street lighting, water, sewer, drainage, and other essential services.
  • Design Standards: All works must comply with the latest Master Municipal Construction Documents (MMCD) and the City’s own supplementary guidelines.
  • Servicing Agreements: If infrastructure can’t be completed upfront, developers must enter into a Servicing Agreement and provide financial security.
  • Building Permits: Certain developments cannot proceed unless required services are in place or secured by agreement.
  • Cost Responsibilities: Developers are responsible for all servicing costs, including upgrades to existing services that don’t meet City standards.
  • Latecomer Provisions: In some cases, developers may be eligible to recover costs from future benefitting developments.
  • Schedules: The bylaw includes detailed technical schedules on design standards for water, sewer, drainage, roads, lighting, and stormwater management systems.
